Whats the matter with my ex-wife? She finds my Great uncles treasure and thinks we can just get back together.?
SO My ex-wife was digging in the lawn our! lawn we were as of late DIVORCED! The other day when looking for a time capsule she burred back when we went out in high school because she had a Quazy Autographed baseball card inside its worth like 2 mill now, and find my great uncles booty. (not like @$$ the money kind) he fought back in WWII and his helmet along with other priceless war antiques in his old chest. The stuff in there is worth more than the house and she claims finders keepers. But to be honest i look better in the old uniform any way so like it should be mine right?
You might want to talk to an attorney about this. If she had full ownership of the house at the time she found the stuff, then it’s hers. Think of it this way — if someone else owned the house and found the stuff, it would belong to them.
That’s not to say that giving family mementos back to the family isn’t the right thing to do. (Your parents or siblings may want them too.)
It sounds to me though that you want the stuff because of it’s monetary value, not sentimental reasons. If it’s the uniform you want, then it can be appraised, and you can request the first right of refusal to purchase it when and if she decides to part with it.
OTOH, if you have joint ownership of the house, then you do have a claim on part of whatever money the sale of the items brings. So, talk to your attorney; there’s sure to be legal precedent on situations like this.
